End User License Agreement (EULA)

1. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the TakeCare application on your personal mobile device solely for your personal, non-commercial use.

1.1 Permitted Uses:

Install the App on devices you own or control
Use the App for personal medication management
Create backups of your health data
Access the App offline for core features

1.2 Restrictions:

You may NOT:

Copy, modify, or distribute the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Use the App for commercial purposes
Rent, lease, lend, or sublicense the App
Transfer the App to any third party

2. Ownership

TakeCare and all intellectual property rights therein are and shall remain our exclusive property. This EULA does not grant you any ownership rights to the App.

2.1 Your Data:

You retain all rights to your health data. We claim no ownership over your personal information, medical records, or health-related content.

2.2 App Content:

All medicine databases, algorithms, designs, logos, and features are our proprietary property.

3. Updates and Modifications

We may provide updates, patches, or new versions of the App from time to time. You agree that we may automatically update the App without prior notice.

Auto-Updates: To ensure security and functionality, the App may automatically download and install updates.

4. Third-Party Services

TakeCare integrates with third-party services:

Supabase: Cloud database and authentication
Expo: Mobile app framework
Device OS: iOS and Android notification systems

Your use of these services is subject to their respective terms and conditions.

5. Medical Disclaimer

The App is NOT FDA-approved or CE-marked
It does NOT diagnose, treat, or prevent any disease
It is NOT a substitute for professional medical advice
Always consult healthcare professionals for medical decisions
We are NOT responsible for medication errors

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of information
Uninterrupted or error-free operation

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall NOT be liable for any indirect, incidental, special, or consequential damages
We are NOT liable for missed doses or medication errors
We are NOT liable for health consequences from app use
Our total liability shall not exceed $100 USD
Some jurisdictions do not allow these limitations

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your use or misuse of the App
Your violation of this EULA
Your violation of any rights of another person
Your health-related decisions based on the App

9. Termination

9.1 By You:

You may terminate this EULA at any time by uninstalling the App and deleting your account.

9.2 By Us:

We may terminate this EULA immediately if you breach any terms. Upon termination:

Your license to use the App ends immediately
You must uninstall the App from all devices
You may export your data before termination

10. Export Compliance

You agree to comply with all applicable export and import laws. You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country.

11. Governing Law and Disputes

This EULA is governed by applicable laws. Any disputes shall be resolved through binding arbitration or small claims court.

12. Entire Agreement

This EULA, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between you and us regarding the App.
